Terms of Service

1. What these terms cover

These terms apply when you create an account with Wombat Preparation (“we”, “us”) or buy a licence for the Wombat Trainer software. By doing either, you accept these terms and our Privacy Policy. If you do not agree with them, please do not use the service.

2. What we offer

Wombat Trainer is downloadable desktop software for Windows, macOS (Intel) and macOS (Apple Silicon). It is an independent simulation for practising the task formats of the WOMBAT-CS test. WOMBAT and WOMBAT-CS are trademarks of Aero Innovation Inc. We are not affiliated with, endorsed by, sponsored by or licensed by Aero Innovation Inc., and the software does not contain the actual WOMBAT-CS test.

System requirements: Windows 10 (64-bit) or macOS 12 or later, 4 GB of RAM, 500 MB of free disk space, a keyboard and a mouse. The app needs an internet connection to sign in and to check in with our licence server; after that it works offline for up to 7 days at a time.

3. Your licence

A purchase gives you a personal, non-exclusive, non-transferable licence to install and use the software for your own test preparation, with no time limit. The licence is active on one device at a time; you can switch devices from your dashboard whenever you like. While the app is online it checks in with our server about once a minute, and it keeps a 7-day offline allowance so you can practise without a connection.

You may not resell or sublicense the software, share your account or licence with anyone else, or reverse-engineer or tamper with the licensing system. If we refund your purchase, or your card issuer reverses the payment, the licence ends and the app stops signing you in.

4. Accounts

Keep your sign-in details to yourself; you are responsible for everything that happens under your account. Use a real email address and keep it verified. We send licence, purchase and security notices there.

5. Price and payment

The licence costs €79 including VAT. That is the final price; nothing is added at checkout. It is a single payment: no subscription, no renewal, no recurring charges. Stripe processes the payment, and we never see or store your full card details.

6. Right of withdrawal

Consumers in the EU/EEA/UK have a 14-day right to withdraw from a distance contract without giving a reason. The software is digital content not supplied on a tangible medium. If, at checkout, you expressly request immediate supply and acknowledge that you thereby lose your right of withdrawal, and we confirm this in your order e-mail, the right of withdrawal is lost from the moment the software is made available for download (Art. 16(m) Directive 2011/83/EU; чл. 57, т. 13 ЗЗП). If you do not give that consent, you may withdraw within 14 days using the form in Annex 1 and we will refund you within 14 days.

The consent is the separate, unticked checkbox at checkout. It reads: “I expressly request that Wombat Preparation supplies the Wombat Trainer software (digital content) immediately after payment, before the end of the 14-day withdrawal period, and I acknowledge that I thereby lose my right of withdrawal.”

7. No outcome guarantee

Practice software cannot guarantee a test result. We make no promise, express or implied, that using the software will get you through the WOMBAT-CS test or any selection process that uses it.

8. Acceptable use

Do not try to bypass or tamper with the licensing system, access the service by automated means outside the desktop app and your dashboard, or use it for anything unlawful.

9. Intellectual property

The software, the website and the Wombat Preparation name are ours or licensed to us. WOMBAT and WOMBAT-CS are trademarks of Aero Innovation Inc. We use those names only to say which test the software helps you prepare for.

10. Legal guarantee, disclaimer and liability

As a consumer you have a two-year legal guarantee of conformity for digital content under the Bulgarian Act on the Supply of Digital Content and Digital Services and the Sale of Goods (ЗПЦСДС). Nothing in these terms limits it; the remedies are set out in the Refund Policy.

Beyond that guarantee and any other rights the law gives you, the software is provided as is, and our liability is limited to the amount you paid for your licence, except where the law does not allow such a limit.

11. Termination

We may suspend or revoke access if you break these terms, for example by sharing a licence or committing payment fraud. You can stop using the service and delete your account at any time.

12. Governing law and complaints

Bulgarian law governs these terms. If something goes wrong, email support@wombatpreparation.com first; we aim to reply within 2 business days. You can also complain to the Commission for Consumer Protection (КЗП, kzp.bg), which supervises distance selling in Bulgaria and offers out-of-court dispute resolution through its conciliation commissions, or to the consumer protection authority in your own EU country.

13. Changes

We may update these terms. The “last updated” date above changes when we do, and using the service after a change means you accept it.
